Uncertainty On “Aadhaar Linking Deadline”, Supreme Court To Pass Order Over It

The Supreme Court will be passing an appropriate order over the uncertainty on the “Aadhaar Linking Deadline”, i.e. March 31 which might extend has gained the attention of many financial institutions in India as they might bear loss or imbalance which will affect the country drastically.

The constitutional bench consisting of five judges with Dipak Misra as Chief Justice commenting on the issue says that it will be nearly impossible to pass the final verdict by March 31 on loads of petitions filed against the “Aadhaar Act” constitutional validity as the case might stretch long. The bench hasn’t given any specific date as to when the order will be passed on the uncertainty of the deadline of Aadhaar linking.

The constitutional bench that has justice A M Khanwilkar, Ashok Bhushan, D Y Chandrachud and A K Sikri stated on the matter that if the deadline will be extended at the very last minute that it will create complications on banks, stock exchange and other financial institutions of the country that relate to the matter. Justice D Y Chandrachud mentions that financial institutions like stock exchange and the bank will be under huge compliance if the court passes an interim order on March 27.

The issue of extending the deadline of Aadhaar linking rose in other petition’s hearing in which the CBSE was instructed by the court that the students should be allowed to getting themselves enrolled for the NEET 18 exams without keeping the Aadhaar number mandatory.

K K Venugopal, the attorney general mentioned that before the Aadhaar Act came into existence, i.e. in 2016, all the court’s interim orders passed on the matter will have no implications in the current scenario. The constitutional bench stated that on December 15, 2017, the interim order passed by the court will be followed by the center and the state. The order stated that the extended deadline of Aadhaar linking till March 31 is to be followed until the matter is solved or the next order by the apex court.
